1. ACCEPTANCE OF TERMS

By accessing or using the Beaverstone Inc. rental application platform (“Service”), you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Beaverstone Inc. (“Company,” “we,” “us,” or “our”), a California-licensed property management company operating under Department of Real Estate (DRE) License No. [LICENSE NUMBER]. We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the platform. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. ELIGIBILITY

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into binding contracts
  • All information you provide is accurate, current, and complete
  • You will maintain the accuracy of such information

3. ACCOUNT REGISTRATION AND SECURITY

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. We employ industry-standard security measures including:

  • Two-factor authentication (2FA) via SMS
  • Email and phone verification
  • Encrypted data transmission (TLS/SSL)
  • Secure document storage with encryption at rest
  • Password hashing (bcrypt) — passwords are never stored in plain text

4. RENTAL APPLICATION PROCESS

4.1 Application Submission

When you submit a rental application through our Service, you acknowledge and agree that:

  • The application is for a specific property managed by Beaverstone Inc.
  • All information provided is true, accurate, and complete to the best of your knowledge
  • False or misleading information may result in immediate rejection of your application or termination of your tenancy
  • We may verify all information provided through third-party services
  • Submission of an application does not guarantee approval or acceptance

4.2 Fair Housing Compliance

Beaverstone Inc. is committed to compliance with all federal, state, and local fair housing laws, including but not limited to the Federal Fair Housing Act, the California Fair Employment and Housing Act (FEHA), and the Unruh Civil Rights Act. We do not discriminate based on:

  • Race, color, or national origin
  • Religion or creed
  • Sex, gender, gender identity, or gender expression
  • Sexual orientation
  • Marital status
  • Familial status (including children under 18)
  • Disability (physical or mental)
  • Source of income (including Section 8 / Housing Choice Vouchers, where applicable)
  • Genetic information
  • Any other protected class under applicable federal, state, or local law

If you believe you have been discriminated against, you may file a complaint with the U.S. Department of Housing and Urban Development (HUD) at 1-800-669-9777 or the California Department of Fair Employment and Housing (DFEH) at 1-800-884-1684.

5. CREDIT AND BACKGROUND CHECKS

By submitting a rental application, you authorize Beaverstone Inc. and its designated agents to:

  • Obtain consumer reports and investigative consumer reports from one or more consumer reporting agencies, including but not limited to TransUnion, Experian, and Equifax
  • Conduct criminal background checks through authorized third-party screening services
  • Verify your eviction history through court records and reporting agencies
  • Contact previous landlords, employers, and personal references to verify the information you provided

These checks are conducted in accordance with the Fair Credit Reporting Act (FCRA) and the California Investigative Consumer Reporting Agencies Act (ICRAA). You have the right to:

  • Request the nature and scope of any investigation
  • Receive a copy of any consumer report used in the decision
  • Dispute inaccurate information in your consumer report
  • Be notified if adverse action is taken based on information in a consumer report

6. FEES AND PAYMENTS

6.1 Application Fees

An application fee may be required at the time of submission. Application fees are non-refundable once processing has begun, except where required by California law. In accordance with California Civil Code Section 1950.6, the application fee will not exceed the actual cost of the screening process.

6.2 Payment Processing

All payments (application fees, rent, and other charges) are processed through Stripe, a PCI DSS Level 1 certified payment processor. By making a payment, you agree to Stripe’s terms of service. We do not store your full credit/debit card number on our servers. You are responsible for ensuring that your payment information is accurate and that sufficient funds are available.

6.3 Rent Payments

If your application is approved and you enter into a lease agreement, rent payment terms (amount, due date, late fees, and grace period) will be governed by your lease agreement. Online rent payments made through our platform are subject to these Terms and the payment processor’s terms.

7. PRIVACY AND DATA PROTECTION

We take your privacy seriously. Your personal information is collected, used, and protected in accordance with our Privacy Policy. By using our Service, you consent to our collection and use of your information as described therein.

8. PROHIBITED USES

You agree not to use the Service to:

  • Provide false, misleading, or fraudulent information in any application or communication
  • Impersonate any person or entity, or falsely claim an affiliation
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Attempt to gain unauthorized access to other user accounts, systems, or data
  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Upload malicious software, viruses, or other harmful code
  • Scrape, crawl, or use automated means to access the Service without our written permission
  • Use another person’s identity, Social Security Number, or financial information without authorization

9. INTELLECTUAL PROPERTY

The Service and its original content, features, and functionality are owned by Beaverstone Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

10. DISCLAIMERS AND LIMITATIONS OF LIABILITY

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, Beaverstone Inc. disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no guarantee that:

  • Your application will be approved
  • Any specific property will be available
  • The Service will be uninterrupted or error-free
  • Defects will be corrected

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAVERSTONE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Beaverstone Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Any information you provide that is false, misleading, or inaccurate
  • Your violation of any applicable law or regulation

12. TERMINATION

We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. DISPUTE RESOLUTION AND GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue legal remedies.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in San Bernardino County, California, and the parties hereby consent to the personal jurisdiction and venue therein.

14. ACCESSIBILITY

Beaverstone Inc. is committed to ensuring digital accessibility for people with disabilities. 15. FORCE MAJEURE

Beaverstone Inc. shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay arises from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, government actions, power failures, internet or telecommunications outages, or cyberattacks.

16. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, SMS Terms, Cookie Policy, and any lease or rental agreement you may enter into, constitute the entire agreement between you and Beaverstone Inc. regarding the use of the Service and supersede all prior agreements and understandings.
